Most employment in California is “at will”, but that does not mean an employer can fire someone for any reason. A termination can be unlawful when it is based on a protected characteristic, is retaliation for protected activity, breaches a contract, or violates public policy.

Signs your termination may have been unlawful

  • You were fired soon after reporting harassment, discrimination, unpaid wages or a safety issue.
  • You were let go shortly after requesting medical leave or an accommodation.
  • The reason you were given changed over time or does not match your record.
  • Others in similar roles who are not in your protected group were treated differently.

What to do next

Write down dates, names and what was said, and keep any documents you already have (offer letter, pay stubs, reviews, messages). Deadlines apply, so speak with an employment attorney as soon as you can.
